1. Acceptance of Agreement

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Hiraki Digital ("Company," "we," "us," or "our"), concerning your access to and use of our website and the digital services we provide.

By accessing our services, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using our services and must discontinue use immediately.

Hiraki Digital provides professional digital services including, but not limited to, web design, software development, branding, and digital marketing. Each specific project will be governed by a separate Service Level Agreement (SLA) or Statement of Work (SOW). In the event of a conflict between these Terms and a signed SOW, the terms of the SOW shall prevail for that specific project.

You agree to pay all charges at the prices then in effect for your purchases. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

• Payments are accepted in GHS, USD, or other pre-approved currencies.
• We reserve the right to suspend all active services and hosting if invoices remain unpaid past the due date.

5. Acceptable Use

You may not access or use the site for any purpose other than that for which we make it available. Prohibited activity includes:

• Systematic retrieval of data to create or compile a collection or database.
• Circumventing, disabling, or interfering with security-related features.
• Engaging in unauthorized framing of or linking to the site.
• Using the site in a manner inconsistent with any applicable laws or regulations.

In no event will Hiraki Digital or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, or loss of data arising from your use of our services, even if we have been advised of the possibility of such damages.

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of: (1) your contributions; (2) use of the services; or (3) breach of these Terms.

These Terms and your use of our services are governed by and construed in accordance with the laws of the Republic of Ghana. Any legal action or proceeding shall be brought exclusively in the courts located in Ghana, and both parties consent to such jurisdiction.

9. Modifications

We reserve the right to change, modify, or remove the contents of these Terms at any time or for any reason at our sole discretion without notice. Your continued use of our services after such changes signifies your acceptance of the updated Terms.
